In this Privacy Policy, Brick will sometimes be referred to as ‘we’, ‘us’, or ‘our’. Additionally, there are references to “You”. In these instances, “You” may be a visitor to our site, or a user of our Services (“Provider”), or a customer of a Provider (“End User”).

Personal Data

Collection of your personal data

When you use our Services we will have access to your personal data that you submit to us and personal data held by Account Servicing Payment Service Providers (i.e. any payment service provider, such as a bank or a credit card issuer that maintains an online payment account on your behalf) (“Data Providers”) (“Personal Data”) for the duration of the transmission.

Such Personal Data may include your date of birth, gender, account information, account balance, transactions, information on loans, insurance data and investments data. The manner in which we access, use, process and store your personal data for the provision of the Services is set out below.

When you use our website (the “Site”) we will collect browser information, including your IP address. We will also store some cookies (see our Cookies section below for more details).

Use of your personal data

Your Provider will direct you to use our Services which will include the following:

  • We will provide you with a software tool (“Tool”) which you can use to transmit information (including personal data) relating to payment accounts (“Account Information”) that you hold with Data Providers to your Provider, and for Payment Initiation, which you can use to consent to and authorize a payment as specified by your Provider; this may require that your Provider sends us your bank account details;
  • To use our Services you may need to provide the same identifying information that you use to login to your online bank account to access your relevant payment accounts with your bank (“Credentials”).
  • The Tool may allow you to use your Credentials to retrieve such Account Information as you choose to transmit to the Provider. Schedule 1 to the Terms of Service lists the information that you can elect to retrieve and transfer using the Tool.

You should check your Provider’s rules on data privacy. If your Account Information (including any Personal Data) is transmitted from a Provider to us, or through our software to a Provider, that Provider (and not Brick) is responsible for it.

Our Tool may merge or aggregate Account Information retrieved from your Provider, or a particular Data Provider with Account Information retrieved from other Data Providers where you or your Provider have instructed us to access and transmit such information.

When you have signed up on Brick’s website for marketing purposes we will use your email address to contact you in relation to products, events and service-related matters, where you have provided your consent to do so.

Retention of your personal data

We will not retain your information for any longer than we think is necessary. Information that we collect will be retained for as long as needed in order to:

  • fulfil the purposes outlined in the ‘Use of your personal data’ section above;
  • in line with our legitimate interest;
  • or for a period specifically required by applicable regulations or laws, such as retaining the information for regulatory reporting purposes.

When determining the relevant retention periods, we consider factors including:

  • our contractual obligations and rights in relation to the information involved;
  • legal obligation(s) under applicable law to retain data for a certain period of time;
  • statute of limitations under applicable law(s);
  • our legitimate interests where we have carried out balancing tests (see section on ‘How we use your personal information’ above);
  • fraud and risk management;
  • (potential) disputes; and
  • guidelines issued by relevant data protection authorities.

Otherwise, we securely erase your information once it is no longer needed.

Types of Personal Data Collected

  1. Identity Data Data that identifies you as an individual, such as your name, ID number, and date of birth.

  2. Financial Data Data relating to your finances, including your bank account number, bank balance, transaction history, and source of income.

  3. Contact Data Your contact information, such as your email address, phone number, and physical address.

  4. Location Data Location information from your device, such as GPS coordinates, IP address, Wi-Fi location, and geo-location.

  5. Time Data Data about the timing of each usage activity, including registration, login, transactions, and more.

  6. Usage and Preference Data Information Usage and Preference Data Information about your usage and preferences, including your interactions with our platform and the settings you choose therein.

  7. Device Information Data Device Information Data about the software and hardware you use to access our platform and its features.

  8. Note Data (Log) Records on the server that include the device’s IP address, date and time of access, features or pages you viewed on the platform, application work processes, and other system activity.

  9. Other Data Other data that you generate through the use of the platform and its features and data that you enter into the platform and its features.

By submitting your Personal Data to the Platform and/or Features, you represent and warrant that:

  1. The Personal Data you provide is accurate, complete, and appropriate to the actual situation.
  2. You have full rights and authority to provide such Personal Data to us.
  3. You release us from any civil claims or criminal charges that may arise due to misuse or incorrect information related to the Personal Data that you provide on the Platform and/or Features.

We reserve the right, in our discretion, to request authentication, verification or updating of your Personal Data. This aims to ensure that your data and information remains accurate, complete and up-to-date. We also have the right to temporarily or permanently suspend your access to certain Features if you do not authenticate or update your Personal Data.

Use of Personal Data on the Platform

On our Platform, we use the Personal Data you provide for purposes relevant to the provision of our services. This includes:

  1. Provision of Services We use your Personal Data to manage your account, facilitate transactions, and provide the services you request, including but not limited to funds transfer services.

  2. Compliance and Security We use your Personal Data to ensure compliance with applicable laws, manage risk, and maintain the security and/or integrity of our platform.

  3. Customer Understanding Your Personal Data helps us understand our users’ preferences and behavior, so that we can improve the user experience, customize services, develop services and/or deliver more relevant content.

  4. Customer Support We use your information to provide customer support, answer your questions, and/or resolve problems that arise in using the platform.

In the event of a change in ownership or a merger of our business, your personal information may be disclosed or transferred to third parties related to the transaction. We will provide notice before your personal information is disclosed or transferred and will comply with applicable data protection laws.

In some situations, we may disclose your Personal Data to third parties, including business partners or trusted service providers, for purposes relevant to the provision of our services. These include:

You also release us from responsibility for losses resulting from third party violations in protecting your Personal Data. This is consent given voluntarily, without coercion, in a conscious state.

We cannot guarantee the security of your Personal Data on third party systems, including third parties with whom we collaborate. We also have no control over third party privacy policies. Therefore, we recommend that you check the privacy policies of any third parties with whom you deal.

We may also use and share your data and information that does not identify you individually for Platform development and collaboration with third parties, without identifying you personally. We always respect your privacy.

We are always committed to protecting your privacy and only using or disclosing your Personal Data as necessary for lawful purposes and in accordance with applicable law. We will always ensure that third parties who receive your Personal Data comply with applicable privacy and security standards.

Data Storage

We will retain your personal information only as long as necessary to achieve the purposes described in this Privacy Policy or to the extent permitted by applicable law. We will delete or destroy your personal information in accordance with our data retention policy.
